1. Introduction Websites Unlimited (“we”, “us”, “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, store, protect, and disclose personal information when you use our website development, hosting, and web development monthly plans (“Services”), visit our website (https://websitesunlimited.co), or interact with us. This policy is governed by the New Zealand Privacy Act 2020 (“Privacy Act”).

  • Client Website Data (as Processor): Content you upload to your website hosted by us, including any personal information contained within that content (e.g., text, images, form submissions). We also process data submitted through forms on your website if stored on our servers (see Section 9). We collect information directly from you when you sign up, configure your account, make payments, or communicate with us. We may also collect technical information automatically when you use our online services.

3. Purpose and Use of Information (IPP 1, IPP 10) We collect and use your personal information only for legitimate purposes connected with our functions and activities, including:

  • Providing, operating, maintaining, and improving the Services.
  • Setting up and managing your account and Client Portal access.
  • Processing payments and managing billing.
  • Registering domain names on your behalf (if applicable).
  • Communicating with you about your account, services, support requests, and updates.
  • Monitoring service usage for security, stability, billing (Fair Usage), and improvement purposes.
  • Complying with legal obligations, resolving disputes, and enforcing our agreements (including Terms & Conditions and AUP).
  • Internal record keeping and business administration.

4. Disclosure of Information (IPP 11, IPP 12) We do not sell or rent your personal information. We will only disclose your personal information in limited circumstances, such as:

  • Third-Party Service Providers: To trusted third parties who perform services on our behalf (e.g., payment processing, domain registration, data hosting/storage, email delivery, technical support tools). These providers are contractually bound to protect your information and use it only for the purposes we specify. Some of these providers may be located outside New Zealand; where this occurs, we take reasonable steps to ensure your information is protected by comparable safeguards (as required by IPP 12).
  • Legal Requirements: If required by law, court order, or governmental regulation, or if we believe in good faith that disclosure is necessary to protect our rights, property, safety, or that of our users or the public.
  • Business Transfers: In connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets, your information may be transferred as part of that transaction.

5. Data Storage, Security, and Retention (IPP 5, IPP 9)

However, no internet transmission or electronic storage system is 100% secure, and we cannot guarantee absolute security.
  • Storage: Your information may be stored and processed on servers located in New Zealand or other countries where our service providers operate (subject to IPP 12 safeguards mentioned above).
  • Retention: We retain your personal information only for as long as necessary to fulfil the purposes for which it was collected, including providing the Services, resolving disputes, enforcing agreements, and complying with legal or regulatory retention requirements. Data related to form submissions on client websites is subject to the retention periods specified in our Terms and Conditions (e.g., typically 6 months for uploaded files). When no longer required, information is securely deleted or anonymised.

 

6. Your Rights: Access and Correction (IPP 6, IPP 7) Under the Privacy Act, you have the right to:

  • Request access to the personal information we hold about you.
  • Request correction of any personal information we hold about you if you believe it is inaccurate, incomplete, or out of date.
 

To exercise these rights, please contact our Privacy Officer using the details in Section 1. We will respond to your request in accordance with the Privacy Act, usually within 20 working days. We may require you to verify your identity before processing your request.

7. Data Processed on Behalf of Clients When you use our Services to build and host your website, you may collect personal information from your own website visitors or users (e.g., through contact forms, e-commerce transactions). In relation to this data:

  • You are the ‘Controller’: You determine the purposes and means of processing this data and are responsible for complying with applicable privacy laws (including having your own privacy policy for your website visitors).
  • We are the ‘Processor’: We process this data solely on your behalf, as necessary to provide the Services (e.g., hosting the website, storing form submissions if configured). We will only process this data according to your instructions (as reflected in our Agreement) and our legal obligations.
  • You are responsible for managing access, correction, or deletion requests from your own website users regarding the data you control.

8. Cookies and Tracking Technologies Our website and Client Portal may use cookies (small text files stored on your device) and similar technologies for purposes such as:

  • Essential Operations: Enabling login functionality and maintaining session security.
  • Performance and Analytics: Understanding how users interact with our services to help us improve them (e.g., using Google Analytics).
