Acceptable Use Policy

1. Introduction This Acceptable Use Policy (“AUP”) forms part of the Terms and Conditions (“Agreement”) between Websites Unlimited (“we”, “us”, “our”) and you, the client (“you”, “your”). It outlines the rules and standards for using our website development, hosting, and web design services (“Services”). By using the Services, you agree to comply with this AUP. Violations may lead to suspension or termination of your Services.

2. General Conduct You must use the Services in a lawful, responsible, and ethical manner, consistent with community standards and the rights of others. You are responsible for all activity conducted through your account and website.

3. Prohibited Content You agree not to upload, store, display, transmit, distribute, or link to any content or materials through the Services that:

  • (a) Are illegal or promote illegal activities under New Zealand law or any other applicable jurisdiction.
  • (b) Infringe upon the intellectual property rights (including copyright, trademark, patent, or trade secret) of any third party.
  • (c) Are defamatory, harassing, abusive, threatening, or constitute harmful digital communications under the Harmful Digital Communications Act 2015.
  • (d) Are obscene, pornographic, depict non-consensual sexual content, or are otherwise “objectionable” as defined by the Films, Videos, and Publications Classification Act 1993 or applicable NZ law (this includes, but is not limited to, depictions of gratuitous violence, cruelty, or exploitation).
  • (e) Contain or promote hate speech, discrimination, or violence against individuals or groups based on attributes like race, religion, ethnicity, gender, sexual orientation, or disability.
  • (f) Contain viruses, malware, ransomware, spyware, or other malicious code intended to harm or disrupt systems or data.
  • (g) Are designed for phishing, pharming, or other fraudulent or deceptive activities.
  • (h) Violate the privacy rights of others.

4. Prohibited Actions and System Misuse You agree not to:

  • (a) Engage in any activity that compromises the security, integrity, or performance of our Services, network, or equipment, or those of any other client or third party.
  • (b) Attempt to gain unauthorized access to any system, network, account, or data.
  • (c) Use the Services to send unsolicited bulk email (spam), or engage in activities that facilitate spamming (e.g., hosting spamvertised sites).
  • (d) Engage in network abuse, including but not limited to denial-of-service attacks, port scanning, or network sniffing.
  • (e) Consume excessive server resources (CPU, memory, bandwidth, storage) beyond the limits specified in your Subscription Plan or our Fair Usage Policy, in a way that negatively impacts other users or service stability. We reserve the right to manage resource usage as outlined in our Terms and Conditions and Fair Usage Policy.
  • (f) Resell the Services or parts thereof without our express written permission.

5. Client Responsibility You are solely responsible for all content associated with your account and website, and for ensuring such content and your use of the Services comply fully with this AUP, our Terms and Conditions, and all applicable laws.

6. Enforcement and Violations We reserve the right, but do not assume the obligation, to monitor compliance with this AUP. If we become aware of or reasonably suspect a violation, we may take immediate corrective action without prior notice, commensurate with the severity of the violation. Such actions may include, but are not limited to:

  • (a) Issuing a warning.
  • (b) Removing or disabling access to the offending content or resource.
  • (c) Suspending your access to the Services.
  • (d) Terminating your account and Agreement.
  • (e) Implementing resource restrictions or applying over-usage charges as per our Terms and Conditions / Fair Usage Policy.
  • (f) Reporting the activity and relevant information to law enforcement authorities or regulatory bodies if legally required or appropriate. We will not be liable for any damages or loss incurred by you or any third party as a result of actions taken under this clause.

7. Reporting Violations If you become aware of any violation of this AUP by another user, please contact us immediately at [email protected]

8. Amendments We may revise this AUP from time to time by posting the updated version on our website or notifying you via the Client Portal or email. Your continued use of the Services after the effective date of the changes constitutes your acceptance of the revised AUP.

9. Governing Law This AUP shall be governed by and construed in accordance with the laws of New Zealand.
